Roberto M. Romero-Perez

Roberto M. Romero-Perez is an Illinois licensed attorney with more than 20 years of combined professional experience in the fields of estate planning, immigration, tax deferred exchanges, and financial services.


My Journey

A native of Mexico, at age 7, he and his family had to leave the country as a result of the prevailing political climate and migrated to the US Commonwealth of Puerto Rico. Mr. Romero-Perez' holds a BA in Economics from the University of Wisconsin-Madison while his law & business (JD/MBA) degrees are from DePaul University in Chicago. After spending many years in the transactional world, Mr. Romero-Perez has been providing pro-bono and Of Counsel legal services in the field of immigration law. In his opinion, those have been the most rewarding experiences in his professional career. .

1031 Exchanges

A tax-deferred exchange (under IRC 1031) allows the taxpayer to defer the gain on the sale of "qualifying property" as long as the taxpayer purchases property of "like-kind". Property that is held by the taxpayer for a productive use or for investment is considered "qualifying property".

Real estate/real property, the most popular type of property exchanged under 1031, is like-kind to any other type of real property (with a few exceptions).

Personal property can also be exchanged under section 1031 of the Internal Revenue Code. Here are some examples of personal property exchangeable via a tax deferred 1031 exchange:

  • Intellectual Property Rights
  • Airplanes, automoviles, farm equipment
  • Telecommunications towers
  • Artwork & Other Collectibles
  • Franchise & Distribution Rights

Again, as long as the property is used for "productive use in a trade or business or for investment", it would most likely qualify for a tax deferred exchange. There are various types of exchange transactions. The most popular are:

  • Simultaneous Exchanges
  • Forward Exchange
  • Parking Arrangements (e.g., Reverse Exchanges)
  • Built-To-Suit Exchanges
Tax deferred exchanges can be used as an Estate Planning tool and also as vehicle to purchase a taxpayer's eventual retirement home.
